Judge’s document demands on Apple could delay Epic Games antitrust ruling

The verdict on whether Apple violated a U.S. judge’s App Store ruling may be delayed for months. This comes after a judge ordered Apple to hand over internal documents related to the lawsuit filed by “Fortnite” creator Epic Games.

At a hearing in the case on Wednesday, a lawyer for Apple told U.S. District Judge Yvonne Gonzalez Rogers in Oakland that three months was a “fair estimate” for how long it would take the iPhone maker to produce the corporate records.
Rogers convened a series of hearings beginning last month to assess Apple’s compliance with her 2021 injunction, which required the Cupertino, California-based company to give developers more power to steer app users to payment options outside of Apple’s ecosystem.
Epic has argued Apple violated the order, and should be held in contempt. Apple has denied any wrongdoing.
In most instances, Apple charges developers a 30% commission on users’ purchases inside an app. Following Rogers’ injunction, it began allowing developers to include links to outside payment options, but developers are still required to pay a commission of 27% on such purchases.
Apple executives have defended the 27% commission during the hearings. But Rogers questioned how Apple arrived at that number, and she complained at a hearing last week that the company had not fully disclosed relevant internal records.

MacDailyNews Take: Again, as we’ve said now for years, if developers like Epic Games wish to advertise lower prices elsewhere using Apple’s App Store, Apple should simply charge an in-store advertising fee.
Apple certainly has a legal right to charge for in-store advertising.
We’ve long suggested that Apple price it the same as or, better yet, more than current In-App Purchase fees. Apple actually made it less – 27% – and Epic still complains because they want all of the benefits of Apple’s App Store for free.
